Mediation is an alternative resolution to trial. It can save the parties a lot of money. It is not in a courtroom atmosphere. A professional meditator meets with the parties and tries to resolve all issues so the parties don't have to go to trial. Often times the parties attorney draft a mediation summary and gives it to the mediator prior to the mediation meeting. At the mediation hearing usually the parties are put into separate rooms and the mediator bounces back and forth with proposals and counter proposals until the parties reach an agreement. If the parties don't reach an agreement the case proceeds to trial. If the parties reach an agreement then the mediator can record the agreement and the parties can be sworn in and the settlement will be recorded and then the settlement becomes final. Mediation is highly recommended in all divorce cases except uncontested divorces. The mediator can reach a settlement in property, custody, alimony, child support, parenting time. Mediation is usually way more laidback compared to going to a divorce trial.
